Jessica H. Sanderson is Of Counsel in Gibson, Dunn & Crutcher’s Denver office. She practices in the firm’s Litigation Department with a focus on business crimes, investigations, and complex civil and white collar litigation. Ms. Sanderson has represented clients before state and federal appellate and trial courts throughout the country and has participated in numerous arbitrations, mediations and administrative actions. Ms. Sanderson has conducted internal investigations for corporate clients and responded to investigations by various government agencies, including the Securities and Exchange Commission and the Department of Justice.
Ms. Sanderson has developed particular expertise in the areas of the False Claims Act (FCA) and Foreign Corrupt Practices Act (FCPA). With respect to the FCA, she has successfully represented government contractors, grantees, and lessees in pre-litigation negotiations with prosecutors around the country. Ms. Sanderson helped a consulting firm accused of violating the FCA obtain summary judgment in two separate actions in federal district courts in Texas (after successfully moving to exclude the qui tam relators’ accounting and statistical expert witnesses). One of the cases was appealed to the Fifth Circuit, and Ms. Sanderson was part of the Gibson Dunn team of lawyers who successfully argued the case on appeal. Ms. Sanderson also has published several articles and client alerts in the FCA area and has prepared materials for, and presented at, continuing legal education courses.
With respect to the Foreign Corrupt Practices Act, Ms. Sanderson has advised major corporations regarding their compliance and ethics programs and potential FCPA exposure, and currently is participating in a large international FCPA compliance monitorship, assisting the first, non-U.S. Compliance Monitor in connection with the largest FCPA settlement in U.S. history.
Ms. Sanderson graduated cum laude from Brooklyn Law School in 1993, after receiving her Bachelor of Science degree from Cornell University in 1990. Ms. Sanderson, who is admitted to practice in Colorado and New York, is a member of the Colorado Bar Association and the Denver Bar Association.
