Kathryn M. Cherry

Of Counsel

Kathryn M. Cherry is Of Counsel in the Dallas, Texas office of Gibson, Dunn & Crutcher, where she currently practices in the Firm’s Appellate and Constitutional Law practice group. 

Kathryn has argued cases before the Texas Supreme Court, U.S. Court of Appeals for the Fifth Circuit, U.S. Court of Appeals for the Ninth Circuit, and Texas state appellate courts, and has represented clients in state and federal trial courts and before the First Circuit, Second Circuit, Fourth Circuit, en banc Fifth Circuit, and Seventh Circuit Federal Courts of Appeals, as well as the U.S. Supreme Court. 

Her practice includes significant business matters in the areas of government and private contract disputes, securities law, administrative law, and constitutional law.  Her significant successes include winning dismissal of a nationwide class in a securities class action, dismissal of charges brought by the Securities and Exchange Commission, reduction of a damages award by nearly 90%, dismissal of a False Claims Act suit, and in two matters overturning precedent to establish state-wide requirements for jury instructions favorable to her clients.  Her pro bono work has included representing former judges, prosecutors, and professors, as well as organizations such as Lawyers without Borders, Giffords Law Center to Prevent Gun Violence, and Sanctuary for Families.

Kathryn also has a distinguished record of public service, having served in the U.S. Attorney's Office for the Western District of Texas and in the Texas Solicitor General’s Office. As an assistant solicitor general, she argued several cases and contributed to major successes for the State of Texas on subjects such as tort liability, constitutional challenges to statutes, and procedural challenges for suits. 

Kathryn received her law degree from Yale Law School.  In 2015, after having clerked for now-Justice Brett Kavanaugh and Chief Justice John G. Roberts, Jr., she joined Gibson Dunn’s New York Office as an associate.  She is admitted in the States of Texas and New York, the Northern District of Texas, seven federal courts of appeals, and the U.S. Supreme Court.
