Gibson Dunn Advocates for Maryland in Gun Control Case
A team of Gibson Dunn lawyers recently filed an amicus brief on behalf of the Giffords Law Center to Prevent Gun Violence. Following the 2017 Las Vegas mass shooting, the State of Maryland enacted a law banning bump stocks and other rapid fire trigger activators and related devices that are, in essence, used to convert regular firearms into deadly rapid fire, nearly automatic weapons. Gun owners sued to invalidate the new statute, arguing that the ban constituted a government taking of their property in violation of the Takings Clause of the Constitution. The amicus brief supports the state’s efforts to quash the lawsuit. The D. Md. briefing on the motion to dismiss has just concluded and there has not yet been a hearing on the motion.
The brief was written by Jennifer E. Rosenberg, Marc Fagel, and Vivek Gopalan. |
